Charlie Sheen reportedly lost his custody battle over two-year-old twins Bob and Max because he hasn't seen them for three weeks.

The troubled actor had his request to take sole responsibility for the children because his estranged wife Brooke Mueller had relapsed into drug addiction shot down in a Los Angeles court yesterday (19.04.11), and is thought to have lost the hearing because he has spent no time with them since he began his Violent Torpedo of Truth tour earlier this month.

A source connected to the case claims judge Hank Goldberg may have changed his mind had he not been touring the US.

The insider told RadarOnline.com: "Judge Goldberg didn't feel that a change of custody was in the best interest of the boys at this time.

As it stands, Charlie is allowed to see them every other weekend, with his own nannies taking care of them.

"He indicated that if Charlie wasn't currently on tour through the end of the month, his decision might be different.

"As it stands, Charlie is allowed to see them every other weekend, with his own nannies taking care of them."

The former 'Two and a Half' men star reportedly requested to see them next week when he was in Los Angeles but it was denied because it was not on a pre-agreed date.

The source added: "Charlie wanted to see his sons while he was in Los Angeles Monday (25.04.11). Charlie's attorney made the request but was shot down by Brooke's lawyer because it wasn't his day to see them."

Brooke has re-entered rehab after failing to take a drug test late last week, and her mother Moira Fiore is looking after them while she is gone.
