What some people forget on this forum is there was a guy not too long who was dying in six months and I am sure most of our situations are not so dire. Look we all will get GC, we are AOS pending it is a matter of a year here and a year there. But please do not fight like this, we are a community. We were one group before these VBs and now we fight amongst ourselves. It amazes me how the gora man is still able to divide and rule. Chill and relax....go watch olympics.

For those who care to read...the fact that I am suggesting that people should port their priority dates before that door closes shows that I believe that people who have played by the rules (ie actually put in the 5 yrs experience or find a job with EB2 requirements) should get preference !!
I call this the plight of EB2 india because as the rules are set up, in theory, if majority of EB3 ported priority dates, then yes, EB2 with later dates would truly get the short end of the stick.
Having said that, the backlash against people like SunnySurya is unfair. From his perspective, he is right and the law grants him the right to sue if he feels so.
THe problem in these forums is that any mature discussion is not possible because any dissenting voice is soon suppressed with ad hominem attacks such as the gentlemen who wanted to buy me tickets to india.

Immigration Voice is organizing its first peaceful protest rally in San Jose, CA on July 14th in order to protest the broken system of legal high-skills immigration. This protest march is being organized to oppose the enormous visas backlogs in the employment based immigration system. This protest march is also intended to oppose the recent decision of USCIS to block the adjustment of status petitions in July resulting from an unprecedented out-of-order reversal on the part of DOS and USCIS.

I'm July 2007 filer and per the Aug visa bulletin my I-485 application is current (PD - Feb, 2006). I raised a SR with NSC on 15-Jul to find out the status of my application and here is the response I got from them today:
The processing of your case has been delayed. A check of our records establishes that your case is not yet ready for decision, as the required investigation into your background remains open.
Until the background investigation is completed, we cannot move forward on your case. These background checks are required to be completed on all applicants who apply for the immigration benefit you are seeking. We will make every effort to make a decision on this case as soon as the background checks are complete. If you do not receive a decision or other notice of action from us within 6 months of this letter, please contact customer service at the number provided below.
I'm kind of worried as I haven't seen folks getting this response. I haven't gotten even a DMV ticket and not sure why would I get that kind of response. Please advise what should be my next course of action and if there is anything I can do from my end.

3. To keep track of the applicants as when its refiled, it should have yes for "Did you ever apply adjustment of status before". If its "No", its a lie and its rejected again.
If they have to log this information then they may encash the cheque for this work. :eek: :eek:

Anybody has this situation?
My case was sent by my attorney June 29th (current July bulletin) USPS certified mail.
As per USPS online tracking record it was delivered July 2nd 12.45 PM.
No receipt yet. So far sounds okay.
But I got the copy of actual delivery receipt stamped by F.Heinauer (Director NSC USCIS) with the date 062907.
It is a stamp so some of their employee clearly has stamped it.
Now I am confused if that’s the receipt date they are going to go with and may reject the application.
And with this many application it may take more than AUG 17th to receive anything back.
I am very sure it was reached on July 2nd. It was only sent June 29th afternoon.
And USPS is telling there is no delivery can reach so fast. According to USPS the guy who might have stamped the delivery did not changed the stamp date from 0629 to 0702 since it was a weekend.
Anybody in the same situation? Any advice?

Congratulations.
You have the right to feel what you want. But here are my 2 cents:
You on paper are now an American. It gives you good easy travel without visas etc. However people WILL treat you by your appearance/color/etc...
I request you to help your birth country by donating to schools etc like you donate to charities here(goodwill store etc).

No. "Canadian experience" is just a lame excuse, partially because Canada has a very subtle racism feeling, but mainly because the economy there is sluggish and weak. I have Canadian PR and lived there for a year seeking jobs. I have dozens of friends, some born in Canada and holding PhD in IT.
I recall very well when I landed there in 1998, I talked to a gentleman who was white, blue eyes. He was the counselor for a government placement program, an educated man. He grew up in Toronto; he reported to me that he felt that many employers in Vancouver, BC many times discriminated him based on his accent from the East. Another gentleman, at the same freaking day I arrived at the airport, was from England and worked in the financing sector. Again, I will never forget he told me "if you ever get a chance to go to the US, go immediately. Canada has no future". Then I met a girl the same day who told me she immigrated to Canada from the Middle East, but kept working illegally in the US. She said that living illegally in the US, with some restrictions applied, is way better than living as a legal resident in Canada. As my friend told me many times, Canada sucks. If you have a warm and sweet family back home and can get an OK job back home, think about it before going to Canada. You may end up there frustrated cursing your idea of coming here to North America. Of course if you come from a hostile place, extremely poor, etc, Canada or many other places should be a good option for you. That's different.
I would think IT experience is the same anywhere so taking it to canada should be ok? If not there are plenty of other management jobs there. It might be a new start but in a one year timespan you will be well established.
Is it just my wishful thinking?
As for masters, are you persuing MBA? How about PMP?

I have not contributed much as comapred to top guys but I have generated atleast $600 through my efforts to rope in new guys & requested them to put in some money. Some did but some did not

Listen, I have hope that some form of legal imm legislation will pass some day, may be within a year, but I do believe it would take some serious lobbying efforts by powerful people to achieve that. That just seems to be the reality. You can try to ignore reality if you want.
