This is a great point. Even if we get one time relief,that should suffice because retro might not happen in the future as there will not be 245si/195kH1bs. I hope one of the core group members might want to look at this. This will atleast counteract the exaggerated and bloated immigration numbers by the antiimmigrant groups.
What you are not counting is the people who change jobs. Initial H1 allocation to wipro or TCS or satyam doesnt mean anything. More than 50% of those change jobs later on

Is this a parody post? How exactly is the law favorable to EB3? Just because they are allowed to file in EB2 later? Does this mean the law also favors children because it allows them to grow up? EB2 is in 2006. EB3 is stuck in 2001. "Plight"? Give me a break.

One of my best friends has good FTE offer from one company in WestCoast.Right now he is working as subcontractor at client place in Boston but by looking at the market recession/depression, he is inlined towards this offer from the previous client manager in CA.
He is on H1 for 5 yrs and is into 3 yrs extension based on approved LC/140.He got EAD/AP approved and his EAD recently extended for 2 yrs.He is married, H4 wife with school aged kids.
He is with this Desi employer for 5+ years so his employer is generous about not cancelling his approved 140 for the bucks he made on this guy for the last 5 yrs. But my buddy is planning to ask his employer about keeping his H1 active, means he doesn’t want his employer to cancel his H1.He want to take up the FTE opportunity using EAD. He was asking me about his H1 status when not getting paid/no pay stubs and leaving it just like that until it comes out for renewal which is after 3 yrs…when I asked why he wants to do it he said he just want to keep it as backup incase his 485 get denied so that he can use the remaining period of H1.But I have my own doubts about his H1 and EAD usage.
Now my Question is can he stay on H1 with the Original employer without working for him (that means no salary/pay stubs) and work for this new company that is offering FTE for him?
I told him that he might have to do AC-21 stuff but he said he don’t need to do it as he is not changing his employer, Is that true? He is saying that AC-21 wld come into the picture only when if u switch employer / 140 got revoked.
Looks like he can get paid by the new employer by 1099, is that correct?.
Also I’m skeptical about using EAD while keeping your H1 with original employer.

Like how can we show pay stubs from new employer as proof of employment when your LC/140/484 are coupled to previous employer and you are not in his payroll though your H1/140 is not cancelled?
Has anybody done this? If so can I know what are the pros and cons?

Anyone thinking that there will be a bill passed in near future that will overhaul skilled immigration process needs a reality check. Now I am not discouraging anyone from trying, I am also suffering through this mess and in no better position. The reasoning behind my assumption is following:
1. Lawmakers serve America and Americans. In theory anything that passes must look like it is serving their interest. Most laws/actions MUST look like it is helping Americans directly or indirectly, more so in an election year. That's why with less than 60 days for election it is not wise for them to spend time in enacting and debating laws that helps immigrants. It simply makes no sense.
2. You can argue that helping skilled immigrants will help America greatly and there is an urgency to enact such laws. Unfortunately no matter what media says, there is no such urgency seen by either law makers or their advisers. The reason, being there is no mass exodus for skilled immigrants, I know a few who have gone back but most of us are still here waiting for visa bulletin evey month hoping that some miracle will happen some day. Even if there is a mass exodus, there are enough people in India/China/Eastern Europe who will be more than happy to be here and do whatever we are doing. Simple law of numbers.
3. It can also be argued that America is not producing enough talents in Science and technology and hence we should throw a red carpet to anyone who can buy his way through the MS program from an American university. Unfortunately for us, a lot of us are doing mundane jobs and do not make a big impact in the economy the way techies used to be in late 90's. The best and the brightest are well taken care of (read: EB1/NIW) even today, for the rest us there isn't a desire nor a need to expidite the process in any manner. It will only help us, and we don't matter.
4. There isn't much shortage of skilled professionals, definitely not of the proportion that 65,000 visas are gone in 2 months. The only shortage I see is of numbers of "Visas". Although it is hard to find good people in technology but that problem cannot be solved by making that number higher. I am not sure what's the reason.
So what can we do ?
In short we are just a John Doe seeking better life which unfortunately isn't there in our home country. We should enhance our Skills (NOT skill bill) and help ourself to do well in anywhere. One thing is use 3 years extensions to chnage jobs and do well.
We can also align ourselves with H1B lobby/Healthcare lobby and request to file I-485 without visa numbers. That will at least stop some of the indentured servitude and our spouses can work.

I totally agree everbody. ICICI bank all time sucks. I have account with them for 5 yrs. and everytime I do transfer money to India (FYI I do Wire Trasnfer On Monday morning US CST only should be credited in 1 business day, expected that the money will be credited by Tuesday IST ICICI Business time). What happens eveytime they will credit after 5 business days and provided with lowest Exchange rate. I had big fight with poor customer service people.
One time funny thing happend. I did wire transfer money from my local back to New york bank (ICICI) . My local bank confirmed in an hour that the money got credited in NY bank. I thought money was credited to my local ICICI bank back India in 1 day. Now fun started I was counting the days 1,2,3,4,5, etc... nothing happend. God know what happend to money. I called CSR... I explained her "money transferred to NY bank a week ago." still not credited to ICICI bank. She was telling me that, I should transfer money again then they will deposit the money. I was totally pissed off for their answer. I said, her money already debited from my local bank and money is sittling in NY Bank(account of ICICI). After 1 1/2 hr on the phone she repeatedly tells me that deposit the money again... I hang up the phone, and wrote a big letter to ICICI Mumbai. Then then deposited me the money. Finally claiming that the money was not showing in NY bank that is the reason they were unable to credit in ICICI NRI Bank.

I am 2nd July filer and till date i did not receive Advance Parole,but my wife received an approval notice from USCIS stating that they approved her AP(but AP not received) .
And Today i got an email from USCIS guys stating that my file for AP is under "Name Check and Background Check"..???????
I just want to know from IV members how much time it will take to get clearance from background check as i have an emergency to go Home country. confused::mad::mad::(:(

I am on my 7th yr extension of H1B and my lawyer has told me that once I apply for 485, I can NOT keep renewing my H1B. That is why he insisted on applying for AP.
whats your PD? Is your I-140 approved?
You can get extensions even after the I-485 is filed. The only grey area is if your I-140 is not approved AND your LC PD is < 365 days.
if I-140 is approved, you should get a 3 year extension (AC21 seems to imply you get an extension only if you cant apply for AOS, but USCIS has been interpreting that as if they cant grant you AOS due to PD not being current). A couple of my friends with non current PD and 485 pending for a while have got 3 year extensions

I am in same situation but I always thought that you have to stay with the company who has filed your 140./ I have 140 approved and wasting my time with the company every day but at the same time started real estate business with my partner part time. I am wondering if there is any way to keep your green card going and at the same time work for your comoany. I really appricate your insight.

1) Use your credit history to purchase additional home in Florida. House purchase in 150000 will be 250000 in year. The market was like that a year back. It takes 8 months to get a house. There is a big line.
2) Open your own e-business. File E visa. 1/4 million should be easy money if you have stayed here for 10 years.
3) House listing in only done by realtor. Give option to customer. For fun open a site for people to list their house for sale. Give them free service then charge. Live American way.
4) Make school in Village. I have made one. I enjoy supporting the school. Grow India.
5) Don't worry about GC. Do something. Registering a site takes some $35 or 40. Built you site. Use American brain.
Am I doing it? Yes.. Did I make money? Yes.

You are missing the point and no i am not kidding. i know you guys are angry that people are not contributing( i am monthly). People have money but they dont care they want a free ride, you cant put your hand in their pocket and amke them pay. The point i am trying make is that instead of complaining we can try and do something positive. There are many ways of contributing.
Getting contributions is always depressing. people will listen but the like watching from the side lines. If have knocked many doors people listen, few act, thats human nature. They like to support winners not strugglers. if you look at the funding patterns of other groups you will find out that they are being funded in a big way by companies or a couple wealthy individuals with an agenda. We on the other hand consist of people who are directly affected by retrogression. Sadly, once (many) deisis get their GC's or become sucessful they wouldnt spend 10cents on our efforts.
i took a couple of days of during the december debacle and called each senator in the list. i email any and every one i know, nothing happened, i felt helpless for a couple of days, then got back to normal.
My IM has a header/identifier that mentions IV, if you have a 50 odd people from your office etc on your IM i am sure 15-20 might visit the the site and a few might even join in. Most of them will ask you about IV. If each one of us can do something little, maybe something positive might happen and most of all the core team can worry about the big picture instead of monitoring threads or provided updates every hour and foucs on their long term efforts.
What is not productive is bitching and moaning about issues like who caused, the mess, how desis screw up and the like....

Everyone in this forum makes good money than an average American and in fact per capita income of Indians in United States is much higher than the per capita income of this country; yet only 2.5% of the people chose to contribute. That shows the resolve of this community to get any kind of relief yet we all complain why illegals get preferential treatment. Because they are vocal and determined to get some relief. They come out in large numbers all over the country to protest and make their voices heard and here we can hardly find anyone willing to tell their story to the media.
In conclusion, it's not that we don't have the money .. we are not willing to contribute and are too busy questioning IV's motive and financials. We would rather pay 20k for sub labor than 20 dollar for IV and this is the attitude which will take us no where in terms of any relief for legal community. God help us all.

I just contributed $100 in addition to $100 for previous drive. I have a suggestion, we have some very successful enterpreneurs with same back ground like Vinod khosla , Sanjeev bhatia etc. Can we ask some contributions from them..

Nope, if you think that the wait time is what makes a GC worth, then would you have liked to wait for another 10 years to make it more worthy?, on the other hand if you had got the GC the very next day you applied for it, would it have been worthless?.
The point I am trying to make is that no one can justify the wait time. it is torture.
